Portrait Commission Contract

And the Artist Heather Collins of LIfe Studios USA. The client is commissioning an artistic portrait of chosen subject(s). By entering this contract the client acknowledges that they have reviewed other work of the Artist and are familiar with the Artist’s style. The Artist’s work can be viewed on the internet at www.lifestudiosusa.com.

A 50% non-refundable payment is required on the date the contract is signed. Final payment is due upon completion of the portrait. Price does not include travel expenses, shipping or framing.
The Client speaks with the Artist to discuss the elements of the portrait such as number of subjects, medium, size, composition, background and the area the portrait will be displayed.
A portrait contract is signed with a 50% payment of the fee.
The photographs that the portrait is based on are emailed or given to the Artist, or a photography session and/or painting sitting is scheduled (approximately 2 hours).
The Artist will be in contact with the Client through email, phone or meetings to give the Client an update on the progress throughout the painting process.
At the completion of the portrait, the remaining final payment is due.
Rights and Usage
Clarification of Artist rights as protected by the Federal Copyright Act of 1976 and the federal Visual Rights Act of 1991.
Purchase of a copyrighted artwork does not transfer the copyrights. The copyright to reproduce the works in copies, to produce derivative work based on the copyrighted image, and distribute copies is retained by the Artist. Any transfer to this copyright must be in writing expressly identifying what rights are being sold and for what purpose.
Works of art cannot be modified without the permission of the Artist. Works cannot be distributed, mutilated or modified in any way that would prejudice the reputation of the Artist.
All photos and sketches are property of the Artist. The Artist will own the copyright and the right to retain pictures and computer files of the piece of art for use in the Artist’s website, portfolio, exhibits, competitions, etc.
